Terms of Service

By registering, purchasing services, or accessing our platform, you confirm that you have read, understood, and agree to comply with these Terms. This agreement is between you ("Customer", "you", or "your") and GetHost Zimbabwe (Pvt) Ltd, operators of wphost.co.zw ("we", "us", or "our").

We may update these Terms from time to time. When we make material changes, we will:

• Post the revised Terms on this page with an updated "Last Updated" date
• Notify registered customers via email at least 7 days before the change takes effect

Your continued use of WPHost after changes become effective constitutes your acceptance of the updated Terms.

To use WPHost Services, you must:

• Be at least 18 years old, or the legal age of majority in your jurisdiction
• Have the legal capacity to enter into a binding contract
• Not be prohibited from receiving our services under applicable law

By using WPHost, you represent and warrant that you meet all of the above requirements.

To access our services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your account information up to date
• Keep your login credentials confidential — do not share your password
• Notify us immediately if you suspect unauthorised access to your account

You are solely responsible for all activity that occurs under your account. WPHost is not liable for any loss resulting from your failure to protect your credentials.

You agree not to use WPHost Services to:

• Violate any applicable local, national, or international laws or regulations
• Infringe the intellectual property, privacy, or other rights of any third party
• Send spam, phishing emails, or distribute malicious code from our infrastructure
• Host or distribute illegal content, including pirated software or materials
• Overload, disrupt, or impair our servers or network infrastructure
• Attempt to gain unauthorised access to any WPHost system or another customer's account
• Engage in cryptocurrency mining using shared hosting resources

Violation of this policy may result in immediate suspension or permanent termination of your account without notice or refund.

Each WPHost service plan is designed and optimised for specific use cases. Please read the following before purchasing:

Accepted Payment Methods: MasterCard, PayPal, and EcoCash. Prices are listed in US Dollars (USD) unless otherwise displayed. We reserve the right to update pricing with 30 days' notice to existing customers.

Billing Cycle: Services are billed in advance on a monthly or annual basis as selected at purchase. Auto-renewal is enabled by default. You may cancel renewal at any time via your client portal before your next billing date.

Taxes: You are responsible for any applicable taxes, duties, or levies on your purchases, including VAT or local taxes in your jurisdiction. WPHost complies with its obligations under Zimbabwean tax law.

By You: You may cancel your services at any time via your client portal. Cancellations take effect at the end of your current billing period unless otherwise agreed.

By WPHost: We reserve the right to suspend or terminate your account immediately and without refund if you:

• Breach these Terms or our Acceptable Use Policy
• Engage in fraudulent, abusive, or illegal activity
• Fail to pay outstanding fees after two reminder notices
• Compromise the security, stability, or performance of our shared infrastructure

Upon termination, outstanding fees remain payable. Your hosted data will be available for download for 14 days after termination; after that period, we may permanently delete it. We strongly recommend maintaining your own backups at all times.

All content, branding, software, and features of the WPHost platform are owned by GetHost Zimbabwe (Pvt) Ltd or its licensors and are protected by Zimbabwean and international intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to use our Services as described in these Terms. You may not reproduce, reverse-engineer, modify, or redistribute our platform without our prior written consent.

Content hosted on our servers by you remains your intellectual property. You retain full ownership of your data and website content.

To the fullest extent permitted by Zimbabwean law, WPHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, business opportunities, or goodwill — arising from your use of or inability to use our Services.

Our total aggregate liability to you for any claim related to these Terms shall not exceed the total amount you paid to WPHost in the three (3) months preceding the event giving rise to the claim.

WPHost Services are provided "as is" and "as available." We do not make any express or implied warranties, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive for 99.9% uptime, we cannot guarantee uninterrupted or error-free operation at all times. Scheduled maintenance will be communicated in advance where possible.

You agree to defend, indemnify, and hold harmless GetHost Zimbabwe (Pvt) Ltd and their respective officers, employees, and agents from and against any claims, damages, losses, or costs (including reasonable legal fees) arising from:

• Your use or misuse of our Services
• Your violation of these Terms or any applicable law
• Your infringement of any third-party rights
• Content you host, publish, or transmit through our platform

Your privacy is important to us. Our Privacy Policy describes in full how we collect, use, store, and protect your personal data. By using WPHost, you consent to the data practices described in the Privacy Policy.

These Terms are governed by and construed in accordance with the laws of the Republic of Zimbabwe. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

If a dispute cannot be resolved informally within 30 days, it shall be submitted to the jurisdiction of the competent courts of Zimbabwe.
